Project Results
In this grant project the problem of the functioning of judiciary was analyzed from the point of view of the theory of incentives, taking advantage especially of the gradually growing understanding of the incentives in the public sector. The relevant concepts of the incentives theory were chosen and applied to analyze the court system. A model was then developed explaining the relationship between the commitment of an institution (like a judiciary) to certain mission and its performance. The results of the model were explained on the examples of the Czech and English judiciary. A stronger mission orientation was identified as an important factor of the superior performance of the English judiciary.
During the realization of the project, a visit to England took place within which meetings with a judge and a court manager were held. Two meetings were also held with the chair of the Prague City Court Jan Sváček.
Preliminary results were published as a chapter in the bulletin of Centrum pro ekonomiku a politiku No. 34/2004. Final results were published as a discussion paper of CERGE-EI (number). A publication of an article in an international journal is planned.
